Arbitration and Mediation Experience

I have been an arbitrator and mediator since 1980 (full time since 1990), involved in commercial, labour, and other areas. As a practising lawyer until 1990 I was involved in most areas of the law. As a mediator, arbitrator, or mediator/arbitrator I have been involved in diverse and often complex commercial mediations and arbitrations, including rental rate determinations, lease issues, contract interpretation (including oil and gas), contract claims, purchase and sale of business/shares, property and business valuations, education issues (including universities, colleges and schools), health issues, construction, divorce property division and support disputes, shareholder disputes, partnership disputes (including professionals), multi-party civil litigation cases, family farm and property disputes, agricultural disputes, claim by drilling contractor, estate disputes, commercial landlord and tenant disputes, a dispute between two railways, negligence claims against railways, fire losses, securities industry disputes (including claims against brokers/companies/insurers), franchise disputes, licensing and royalty agreements, summary judgement applications, wrongful dismissal claims, an internal union dispute, professional negligence issues (including Law Society), personal injury claims including brain injuries, vaccine production and distribution dispute, an international oil and gas/operating agreement dispute, electricity generating plant force majure claims, claim for commission on a Venezuelan petroleum industry contract, costs and interest issues, and NHL salary arbitrations. I have rendered awards in hundreds of labour arbitrations, including interest arbitrations. I am on the Grievance Arbitration Roster for the Province of Alberta. I was approved by the Ontario Minister of Labour as an arbitrator and heard labour arbitration cases in Ontario on a regular basis for several years.

  • Facilitator of settlement of Northland Bank in Liquidation lawsuits
  • Lecturer for several years at Alberta Arbitration and Mediation Society Arbitration course on "Award Writing and Appeal", with primary focus on commercial arbitration.
  • Public Representative (to serve as Chair of panels dealing with disciplinary issues) for the Prairie Region of the Mutual Fund Dealers Association of Canada
  • Public member (to serve as Chair of panels dealing with disciplinary issues) of the Alberta District Council of the Investment Industry Regulatory Organization of Canada (formerly Investment Dealers Association)
